2. TERMS OF SALE

By placing an order you are offering to purchase a product/products on and subject to the following terms. All orders are subject to availability and confirmation of the order price.

Dispatch times may vary according to availability, and any guarantees or representations made as to delivery times are subject to any delays resulting form postal delays or force majeure for which we will not be responsible.

3. CONTRACT

After placing an order you will receive a confirmation email acknowledging that we have received your order. This does not mean that your order has been accepted. You order is an offer to buy from us. All orders are subject to acceptance by Lighting and Interiors. Your order is accepted when you receive an email stating that your order has been confirmed.

4. PRICING AND DELIVERY COSTS

Whilst we try and ensure that all prices, descriptions and details on our website are accurate, errors and omissions may occur. If we discover a pricing error on an order we have received from you, we will inform you as soon as possible. You will then have the option of confirming the order at the correct price or cancelling your order. If you decide to cancel and payment has already been made you will receive a full refund using the same method you paid with.

Prices are liable to change at any time. However, if you are already on our site placing an order at the time of a price change you will only be charged the price that was active when you placed your order.

We accept payment on our website by credit/debit card and PayPal. Payments are subject to verification, validation checks and authorisation by your card issuer.

Orders will only be processed once full payment has been received.

5. AVAILABILITY AND DELIVERY

The website may contain inaccuracies, typographical errors, out of date pictures or other errors. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fulfill any orders that you may have placed based on information on the website that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out of date information regarding pricing, shipping, payment terms, lead time or return policy.

Due to variations in computer screen settings colours may vary from screen to screen. Many products receive updates or changes over their lifecycle eg. type of bulb used. Glass fittings may have variations due to the manufacturing process eg. air bubble, this is not considered a fault with the fitting.

All orders are subject to availability, in the event of supply difficulties or because an item is no longer in stock, we will contact you either by email or phone to advise you of any delay. You can then choose to either wait for the item to come back into stock or cancel your order with a full refund of any payment already made using the same method you paid us with.

We will not be responsible for any delivery delay caused by the unavailability of someone to take delivery of the order at the delivery address.

Please check your delivery within 72 hours to ensure your order is correct and that there are no breakages or damage to any product.

6. REFUSAL OF ORDER

Lighting and Interiors reserve the right to remove any product from the website at any time, or to remove/edit any content on the website. There may be exceptional circumstances which mean that we may need to refuse to process or accept an order after we have received it or sent you an order acknowledgement, which we reserve to do at any time, at our sole discretion. Lighting and Interiors will not be liable to you or any other third party by reason of our withdrawing any product from this website, removing or editing any materials or content on this website or for refusing to process or accept an order after we have received it or sent you an order acknowledgement.

7. COOLING OFF PERIOD AND YOUR RIGHT TO CANCEL YOUR ORDER

If you are buying online (not in-store) and are an EU resident, the EU Consumer Rights Directive provides that you may cancel a contract at any time within 14 days, beginning on the day after you received the products.

If you have purchased products from the website and you decide to cancel your order pursuant to this clause 7, the Directive provides that you must advise us within 14 days of receipt of the products. You can cancel by either calling us at +353 01 460 1052 or emailing us at sales@fantasylights.com stating that you wish to cancel your order contract and quoting your original reference number.

You are responsible for any cost incurred or risk in returning products. You have a legal responsibility to take reasonable care of the products while they are in your possession, and you will be responsible for any diminished value of the goods resulting from the handling of the goods beyond that necessary to establish their nature, characteristics and functioning. Items must not have been installed, have any cables cut and be returned in their original packaging.

If you do not inform us within the 14 day period you will not have a right to cancel the contract and return the products under the Directive. This does not affect your statutory rights and you may still be able to return products under our General Refund Policy.

If you cancel this contract we will reimburse to you all payments, excluding delivery costs. We may make a deduction from the reimbursement for loss in value of goods supplied, if the loss is the result of unnecessary handling by you.

Reimbursement will be made by the same payment method originally used by you in the initial transaction.

Reimbursement will only be made once we have received all goods back.

8. GENERAL REFUND POLICY

For instore and non EU Consumer Rights Directive, returns is as follows:

We strongly advise that you ensure you have checked all measurements, clearances & heights so that all fittings can be installed, are suitable for the location and leave clearance for people to walk under/around. We are unable to offer a refund if items are found to be unsuitable.

All product defects must be notified to us either by phone, email or in-store within 3 days.

If your product does not fit or suit, and goods are returned within 14 calendar days then we may issue you a credit note, less a 20% restocking charge, if items are returned with all original packaging, fitting instructions and have not been used or fitted. A 25% restocking charge will apply if the original packaging is not returned or the product shows signs of wear or installation.

Special orders cannot be returned. A special order is an order for an item not in our standard stock range or specifically made or altered to suit a customer specification.

All returns must be made to our main trading Address in Walkinstown as above.

This does not apply in respect of faulty, damaged or incorrectly supplied goods where your statutory rights are unaffected.

9. RISK AND TITLE

Any products ordered will be at your risk from the time of delivery. Ownership of the products will only pass to you when we receive full payment of all sums due in respect of the products, including delivery charges, or upon delivery, whichever is later.

10. GENERAL

If any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable, the validity, legality or enforceability of any other part of these Terms and Conditions and the remainder of the provision in question will not be affected.
No person other than you and us Costard Investments t/a Fantasy Lights shall have any rights to enforce our agreement, whether under the Contracts (Rights of Third Parties Act) 1999 or otherwise.
If we fail to insist that you perform any of your obligations under our agreement, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
You may not assign or transfer your rights or obligations under our agreement, unless we agree in writing.
We may update, vary and amend these Terms and Conditions from time to time without prior notice. Each time you order or otherwise purchase any goods from us, the Terms and Conditions in force at that time will apply (as set out on this site).
